These Terms and Conditions ("Terms") govern your access to and use of www.leadnesthub.com (the "Site") and any related forms, content, scheduling, messaging, and services provided by Tidemark, LLC DBA LeadNest Hub ("LeadNest Hub," "we," "us," "our") (collectively, the "Services"). By using the Site or Services, you agree to these Terms.

1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services.

2. Services
LeadNest Hub provides lead-generation, marketing automation, and business connection services. Depending on the page or campaign, Services may include receiving inquiries and connecting you with LeadNest Hub and/or independent third-party professionals or businesses ("Providers"). Any agreement or transaction entered into with a Provider is solely between you and that Provider. LeadNest Hub does not control Provider pricing, availability, performance, licensing, credentials, or services, and routing does not constitute an endorsement or guarantee.

3. Your Responsibilities
You agree to provide accurate, complete information and to use the Site lawfully. You agree not to attempt unauthorized access, scrape data, or disrupt the Site or Services in any way.

4. Consent to Communications (Email, Phone, SMS)
By submitting your contact information through the Site, you consent to receive communications from LeadNest Hub regarding your inquiry and related services. Communications may include email, phone calls, and text messages as described below.

Marketing Text Messages.
If you check the marketing SMS consent checkbox and opt in, you consent to receive marketing text messages from LeadNest Hub at the phone number provided. These messages may include promotions, offers, and updates about our services. Message frequency may vary. Message & data rates may apply.

To opt out at any time, reply STOP to any message. After sending STOP, you will receive a one-time confirmation message and will no longer receive marketing SMS messages from LeadNest Hub. Non-Marketing / Transactional Text Messages.
If you check the non-marketing SMS consent checkbox and opt in, you consent to receive non-marketing appointment confirmation and reminder text messages from LeadNest Hub at the phone number provided. These messages will only be sent after you have scheduled an appointment with LeadNest Hub. Message frequency may vary. Message & data rates may apply.

To opt out at any time, reply STOP to any message. After sending STOP, you will receive a one-time confirmation message and will no longer receive these SMS messages from LeadNest Hub. Carrier Liability.
Carriers are not liable for delayed or undelivered messages.

5. Intellectual Property
All Site content is owned by LeadNest Hub or its licensors and is protected by applicable law. No unauthorized copying, reproduction, or reuse is permitted.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADNEST HUB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU IN THE PRIOR SIX (6) MONTHS.

8. Changes to These Terms
We may update these Terms at any time by posting updates on the Site. Continued use of the Site after updates constitutes your acceptance of the revised Terms.

9. Governing Law
These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in Wake County, North Carolina.
